Well, first, as you know, IANAL.

Taking the second part first, Olbermann cites to a different part of the Georgia criminal code than I found, and one that's more directly applicable. GA Code § 21-2-604 deals specifically with solicitation to commit election fraud in the state of Georgia. And it is indeed chargeable as a felony under that state law if the action solicited is also a felony.

The other law cited to is, specifically, 52 U.S.C. § 20511(2)(B) which makes it a criminal offense to deprive voters of a fair and impartial election by "the procurement, casting, or tabulation of ballots that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held."

The problem in both cases is the President's lack of specificity in describing how Sec. Raffensperger was expected to "find" allegedly missing votes for him. It is reasonably clear throughout the conversation that the President believed, or represented a belief, that significant voter fraud had occurred in Georgia during the November general election, that steps to correct it were not being taken, and that Georgia election officials were destroying evidence to cover it up.

Now we know these accusations are false. And the Georgia officials on the call repudiated them unambiguously. But what I think a defense attorney for the President would do if the President were charged with anything under the laws Olbermann cites is speak to the lack of mens rea for a crime. The President may be entirely deluded. But if, as a consequence of that delusion, the President asks the Georgia Secretary of State to find votes that the President believes are missing only due to some prior fraud committed, then he is committing no crime on the phone call. He is merely exhorting Sec. Raffensperger to diligently carry out his duty.

Also of note is that in the wording of the federal law, the President wouldn't be chargeable directly under it because it is not the President who is performing the actions the law criminalizes. He is neither procuring, casting, nor tabulating anything himself. The President would have to be charged under an accompanying extortion, solicitation, or similar statute. And since the President has no direct authority over Sec. Raffensperger, it cannot be a subornation charge either. This is a technicality, of course, but in my reading of the law Olbermann's citation is relevant, but not directly applicable.

Switching over to prosecutorial mindset, you'd have to invoke the whole conversation as context, and argue that it may have been carefully phrased, but was really a wink-wink-nudge-nudge engagement that should be considered in the same way as other kinds of criminal shakedowns. You'd have the ability to show that the President knew, or should have known, that the basis for his claims of fraud was factually wrong, and had already been tested in Georgia courts. You'd have to show his intransigence in accepting on good faith the work of Georgia officials, some of whom were even members of his own political party. Having then shown that the President was proceeding from an unrealistic and factually flawed premise, you could then say that the only reasonable way to interpret the President's remarks were as a cover to "really" ask the Georgia state government to lie or otherwise commit fraud on his behalf.

But again, IANAL.

It's interesting that some of the counties in which Trump votes were allegedly deleted are heavily Republican. Of course, it's also interesting that the article contains no explanation of how the vote deletions occurred, given that voting systems from 4 different companies were used in these counties.

According to the article, 91,823 votes for Trump were removed in Chester County. Given that this number would represent 23.5 percent of the number of registered voters in Chester County and 41.7 percent of the number of votes for Trump in Chester County, I, for one, am having a hard time believing that no one would have been suspicious that something was wrong.

ETA: Trump won only 42.3 percent of the Chester County vote in 2016, so the odds of him having won a minimum of 58 percent of the vote in 2020 (realistically, more than 58 percent since almost certainly not everyone voted) are rather small.

"I'm temporarily assuming complete control of the state, in order to save the nation" is a mantra we've heard many times before. Very, very few of those have resulted in a peaceful return to democracy.

Bubba, rather than cheering in a dictatorship over your country, can you really not think of another way Trump could achieve fair elections?

Before you say it, "Elections will be held when the time is right" is yet another well-worn lie, again used by dictators the world over to maintain control.

Oh, before I forget: you do have evidence of this attempted coup d'etat you claim is happening, right? You wouldn't want to plunge your country into a totalitarian dystopia, most likely accompanied by significant civil violence, just because the very politician who would become that autocrat says there's one happening.
