I suspect that actions which might be considered crimes against the presidential office, the people of the country, and the oath of upholding the Constitution could include utterances, actions and inactions that are not by themselves prosecutable under the first amendment.
The entire screeching act about the first amendment is just a red herring that has nothing to do with Trump being impeached.
Again when someone is wrong and they know they are wrong they will argue the philosophy of the question as a way to avoid the question.
