Start with Scooter Libby. Convicted of two counts of perjury after saying I don't recall countless times. I'm pretty sure some people during the Watergate scandal also faced perjury charges for stonewalling prosecutors that way. It's more than reasonable to not remember everything, but 'I don't recall' isn't a panacea that absolves one from answering questions.

So looking into this as a relevant and hopefully short sidetrack: Nixon aides were disbelieved because Nixon said on the tape to say they didn't recall:

I can’t give any honest — an answer to that that I can recall.’ But that’s it,” the president said in a March 1973 Oval Office meeting, according to the transcript of an audiotape of the meeting that Nixon unsuccessfully fought — all the way to the Supreme Court — to keep under seal.

Re Libby:
Lewis “Scooter” Libby, tried unsuccessfully to use frail memory in his 2006 trial as part of his defense over why he misled investigators looking into the leak of CIA operative Valerie Plame Wilson’s name to reporters.
So he didn't say under oath he didn't recall, he said poor recollection led him to mislead investigators.

So far none of the "I don't recall that meeting with that Russian" has yet to go before a jury.


I don't think we are that far apart in how we are looking at this. Like I said, if there is other evidence then the 'I don't recall' may just make one look all the more guilty on the stand. I'm pretty sure Kushner revising his security clearance application multiple times after every new meeting with a Russian was revealed wouldn't make a good defense in an actual court.

Cohen is probably in the same situation, he can say he doesn't recall but there might be plenty of evidence without his admission.

But I hold to my POV that a required forfeiture of the 5th is not going to be some automatic guarantee that Cohen will then tell all.

I don't think so either. I just saying he can't answer EVERY question posed to him with 'I don't recall'.

I never thought we were. I am not an attorney, but I remember contemplating a long time ago before even we even heard the name Donald Trump what was to stop anyone from just saying I don't recall to every question and being explained that wouldn't work. At some point it becomes clear that the person is just being evasive.

There's no reason he couldn't. The limits on the powers of a President to pardon for Federal crimes are not particularly well defined.

Nobody would have thought that someone would lay down the sort of blanket pardon Ford did. Until he did it, that is.

Why not ? It worked for Jeff Sessions (in that it stopped him perjuring himself and created plausible deniability)

And here's what Politico wrote about that.

I think he's trying to preserve his name for a future run at POTUS. I suppose a POTUS who has a teenage crush on Ayn Rand doesn't seem quite as asinine as it did pre Trump.

To reclaim a modicum of respect, one thing this dim bulb could do on the way out is reign in Nunes. Breath not held.

Myself, I think the Syrians will move their aircraft to alternative locations, mayne even Russian bases in Syria.
