I guess that under oath, she has to answer and the contract is unenforceable, but this is an uninformed guess.
 
One thing I don't understand is what's the end game in all this? Stormy has already gotten all the publicity she could want. Trump wants to keep it a secret, but that is blown wide open. That's not happening. Some people on the Trump side might want to punish Stormy by filing for big monetary damages for violating the NDA, but that isn't going to happen.

So, why are we still in court? Or arbitration, or whatever? Who wins by the continuing litigation?

Pictures? Stormy's team doesn't feel confident selling them unless the NDA is overturned? That doesn't seem all that likely, to be honest. Trump would never have agreed to be photographed, and a hidden camera would likely be illegal with or without an NDA. I sure hope that's not it. There are things you can't unsee.

Wrong. Both Stormy and her lawyer gain by more publicity. Nothing would please them both more then to be front page news for a couple of years. And I bet that Trump is worried that if he gives ground on Stormy Daniels more of his sordid affairs will be brought forward.

Trump is also limited in the damages he could collect regardless of what the contract says. He can only sue for damages and they may not be punitive. What Trump wants is to put this genie back into the bottle as opposed to actual money. This is why they are fighting for private arbitration.

Karen McDougal just got released from her contract with American Media:
McDougal reached a settlement with the publishing company on Wednesday, freeing her from a 2016 legal agreement with The National Enquirer. News of the affair broke in February when The New Yorker detailed an alleged attempt during Trump’s campaign to prevent McDougal from going public about the 2006 affair.

The magazine, owned by AMI, reportedly bought the exclusive rights to McDougal’s story for $150,000 and then spiked the article shortly before the presidential election in what is called a “catch and kill.”

It's all about Avenatti not her, I think. How did she get such an attorney in the first place? He has been involved in some huge cases and now he's representing a porn star? Who even heard of her before this?

He's going after the President. She definitely is not paying him out of her pocket and he has really accomplished nothing so far other than publicity for both. Maybe it's personal or maybe it's for other reasons, but this is his game not hers.

I love the phony perp sketch ;) I think she made that part up out of thin air.

You HAVE no idea what he has accomplished. He was hired to get his client released from the NDA. Now it hasn't happened yet. But I bet he will be successful.

That perp sketch led to the President defaming her which will probably lead to his deposition, and probably Trump taking the 5th. Trump is a moron. He has diahrea of the mouth..(in this case twitter) it also may have been an assist in leading to the raid on Cohen's offices since Cohen said he took out a home equity loan to pay Daniels the130K which if he said it was for anything other than paying off a porn star would be bank fraud.

This is something I really don't understand. He is POTUS, but he spends time on twitter like a 16 year-old highschool kid. Isn't there someone on his staff who can steal his phone away from him?

It's simple, there is obvious wrongdoing, Trump's denials are even more laughable than usual, it fits with what everyon (including many of his supporters) think about him, and there is scope for it to expand into Trump's organised crime links.

Also it's obviously getting to Trump.

Non the less the contract does require lying under oath, a contract that requires illegal actions might well be another reason to void it.

I think there is some fairly strong anti trump backing behind her, so the goal is to get Cohen and Trump to testify under oath where then perjury charges and such can open up. And the text comunictions may also be damning in ways we don't yet grasp.

Why Trump and Cohen are still fighting it, well maybe they are worried about all the other such contracts out there and the evidence they might bring to light?

Quite true!

Considering the vast amount of important nonsense that Trump has been creating over the last three years, it is rather depressing that the one thing that gets more sustained media and public attention than anything else is a brief affair that he had with a porn star over ten years ago.

However, considering that Trump is essentially nothing but a shallow self-promoter, then one should not be surprised to see that the one thing that does create so much attention about him is the brief affair that he had with a porn star.

I think this falls into the same trap as saying Bill Clinton’s impeachment was about a BJ from an intern.

Both cases had/have to do with steps taken after the fact to cover up said indiscretions - lying to a judge in the former, possible bank fraud and/or illegal campaign contributions or who knows what else in the latter.

But no doubt the somewhat sordid tabloid nature of the cases helped/help to maintain interest - its just human nature.

Not at all. This is likely to be the issue that brings him down. Colluding with Russia about things can be really nebulous and hard to prove any real crimes. Here there are real crimes, and ones that Trump should have been aware of.

It is likely that Muller will not get anything directly on Trump committing crimes with Russia. Here who knows how much dirt Cohen has on Trump?

She went to his room, so hidden cameras seem unlikely.

Everyone already believes the affair took place.

Even the campaign finance violation should be minor and taken care of with a fine as far as Trump is concerned. Cohen is mostly at risk there.

We seem to know everything we could possibly know already about this.

Stormy and her attorney have said several times that they believe the NDA is no longer valid. They were saying that a while ago.

We know that Cohen definitely was the first to talk about the payment to Daniels, so he broke the NDA.

I don't see why we're in court, either. I doubt there is anything yuuuuge left to reveal, or it would have leaked out by now.

Stormy must want clear rights to a book or movie, I guess.
A book and movie which would not make much money at all, imo.

Oh, I do quite agree.

While the Stormy Affair is rather boring and unimportant in many ways, however the downwash of the Stormy Affair could be very consuming indeed.

Furthermore, since it is very likely that Cohen is now in serious trouble, then Cohen may do a deal with Muller and flip. And if Cohen flips, then Trump will soon be in quite serious trouble himself.

I expect that even Trump is now starting to see that the various fires and floods that he has started over the years are now starting to close in on him.

I don't agree if the potential felonies involved in the actions of Cohen were things Trump knew about and conspired toward it is serious. The thing is that people are focusing on the irrelevant crap like her spanking him with a magazine.
 
The great thing about it is that the more Trump is distracted by the case, the less harm he'll be doing by appointing incompetent hacks to thousands of unfilled government jobs.

Are people focusing on things like the spanking?

I remember a mention of it for a day or 2 after the initial revelations in her interview, but since then I don't remember seeing it mentioned at all. Much more has been written about the financial/fraud side, and the interconnections between various people involved in the case.

Most likely, as nothing has leaked, and leaks are how this business runs.

Cohen claims a lot of things, he's a lawyer.

I believe Trump would release her from the NDA, but I believe he is actually not part of the NDA, and can't release her.

The book/movie might indeed be popular if Trump gets in trouble over this, but I have never seen that as likely.

If Trump was actually unaware of the NDA, then Trump can't release anyone from it.

He could tell Cohen to drop it, I suppose.

If Trump was in fact aware of the NDA, then Trump is not going to say anything about it at this point, I'd think.

Cohen's maneuverability is getting less and less, though. His run is coming to an end. He's going to have to fish or cut bait soon.

You would think so, but as the beneficiary or the person theoretically damaged by Ms Daniels speaking, his participation in enforcing the NDA is required.

Yep. He's also going to be in a position where he probably will take the 5th. And contracts are funny things. Parties must enter into them with clean hands. When one party is taking the 5th regarding how he entered into this contract, it is not likely to play well. This is not worth it.

It may be a sideshow compared to other potential criminal activity by Cohen, but the Stormy Daniel's stuff would still significant enough to pursue on its own, and in some cases the charges are a lot more straight forward. (Did he act without informing Trump? Did he lie on his loan application to pay off Stormy? Pretty cut and dry issues. A lot simpler case than trying to crimes that are a lot more complex.)

At the very least, it provides additional leverage to be used against him. "We'll drop the charges involving money laundering and only charge you with lying on your loan application if you agree to testify".

Stormy is just a door that opes up into a room full of far more problematic issues for Cohen, Trump, and others.

When a rock gets turned over, it isn't the rock that is important, it's what crawls out from under.

During this entire Trump Experience the leaks have generally been from the ones trying to boost Trump, although they haven't always been well advised about what to leak.

The investigations have been played pretty close to the vest.

People have made money off of much less, but I think anything specifically about the Stormy-Trump liaison will be small beer when all is said and done.

She's welcome to whatever she can get out of it. But she'll still only be the nail that caused the horse to throw a shoe.

Isn't Cohen less Mueller 's target and more the federal Southern District of NY's? I think I read thaz even if the Mueller probe gets shot down, investigations against Cohen won't be much affected. I wonder thus if Cohen can save some if his arse by flipping on Mueller.

If she had evidence of criminal behavior in the matter of the NDA, the NDA wouldn't matter anymore, she could go straight to the FBI with it. Her attorney would have done just that, imo.

She and her attorney should have known long ago if she had anything the FBI could use relating to activities by Cohen or Trump or whoever.

An NDA involving criminal behavior is instantly invalid for certain, and any attorney knows that.
