There's not enough detail to tell for sure, but it sounds like an "adjustment" that had been made in advance, not when riders were boarding the ride immediately before the accident. Some sources are saying two seats were modified.

It's possible the staff operating the ride day to day were just told to use the "special" seats for very overweight riders, and that it would be safe for them to do so as long as the indicator lights went green. Whoever actually did the modification, whatever tools or means they used, is in big trouble.

Probably, but to answer your question IMHO it makes it less likely that the park and ride operators can argue that they tried to turn him away from other rides and were doing their due diligence but for the "rogue" operator of this ride.

AMusment park also has to worry about state regulators coming down hard.

I am sure the operator of the ride will be used by the park owners as the sceapgoat, but that is going to touch to make fly since they are supposed to keep an eye on what the operators do.
