Thanks for the link. A case I was not familiar with at all, yet it follows the same depressing pattern of the Lundy and Watson cases - tunnel vision, sloppy police work and dodgy evidence. What's most concerning is the justice system circling the wagons and denying him the right to any avenue of appeal. I would have thought the prosecution lying about the watch would have been enough to earn him one. Apparently not in NZ. |

In fairness, I am not sure they lied about the watch. Well, even as I type that, I guess they did insofar as they stated it was Hoglin's watch without proof. Is a false assumption a lie?
hmmm. One of the wry comments was, how unlucky were these tourists? They were murdered by one Coromandel offender, and then their car was stolen by another bush dweller who had manslaughtered a 22 year old and home invaded and raped a 62 year old? Yet in a sense these are not dependent throws of the dice. You are murdered in a remote location, then after two days your "abandoned" car is stolen independently by another miscreant. This seems very plausible. |

If you were being generous you'd call it sloppy police work. If they presented the watch as being Hoglin's without any corroborating evidence, and without any attempt made to determine it's provenance, then I'd call it a lie, because the prosecution could have presented it to the court as speculation, instead they presented it as fact.
Agreed. An abandoned car in a remote location is eventually going to be broken into by someone - I'd be surprised if it didn't happen. |

And that person will have a criminal history. But that person will not have murdered the recent lessees two days earlier.
How much artifice and second guessing was going on with Tamihere? The pattern is common, behaviour after a crime is either consistent or not with guilt. Here it seems implausible, but other experienced criminologists might see something I am missing. |

Again agreed. You also don't normally leave your car with all your possessions in a remote location for any length of time, unless something has happened. A breakdown would be the most likely cause, but the longer the car is abandoned in such a state, the more likely it's something bad (accident or foul play). Perhaps that reasoning is somewhat circular, but I think that the scenario of two independent acts (murder and theft) happening so close to each other is more probable than would appear at first glance.
Driving around in your victims car, you're either not guilty, or a complete idiot. It's not uncommon for dumb criminals to use their victims possessions though, so I wouldn't discount it. Tamihere is not being accused of being a criminal genius like Mark Lundy. |

The unsolved/unresolved cases are charecterised by multiple appeals, and refusal to show remorse. David Tamihere follows the pattern. Without going back to the links, there appears to be a plausible alternative suspect, with a specific and detailed account of an assault.
I now regard the murders of Hoglin and Pakkonen as unsolved, and we should be curious why Law Enforcement have abandoned the search for the killer, as they have done for the killer of Scott Guy. (who was not Ewan McDonald) |

There are a couple of peculiar things about this case that cause me concern. Firstly, a key part of the case against him was that Police accused him of stealing Urban Hoglund's watch and giving it to his son. It was the Police's so-called proof that Tamihere had been in personal contact with Hoglund, but when Hoglund's body was discovered, the watch was still on him.... the Police lied. Secondly, the Police had a jail house witness who testified that Tamihere had confessed to cutting up the bodies and throwing them into the ocean. The discovery of Hoglund's body on dry land 73 km away from where the Police said the murders took place makes them liars again. There is no doubt that Tamihere is a real bad bastard with a long criminal history that includes manslaughter, burglary, assault, sexual violation and menacing. I'm not so concerned about his being in jail for a crime he might not have committed as I am that, if he didn't do it (and it seems entirely possible that he didn't) then the real perpetrator is still at large. |

One thing about the car Tamihere stole.
Did Tamihere have a record of car conversion? I can't see any, and starting a car without a key is a trick not many ordinary crims know, so if he has no record for it, it would be quite damning that he was able to hook it. |

Without any doubt David (Wayne) Tamihere is innocent of these murders.
He could explain exactly how to unlock their car a year later with number 8 wire. This is a data point that makes every aspect of the crown theory impossible. Once more a dangerous killer was allowed to roam free. |

Showing my childhood upbringing a bit too much but half the cars around could be broken into with a coat hanger and some ripping up the ignition in the late 80's. So considering I could start my sister's Morris from the 70s with a two cent piece I'm thinking it's feasable

I would like to state a truism to help you in your bewilderment Atheist.
Writing a work of non fiction requires extensive research, and under normal circumstances the writer will get closer to the truth. I see no point in theorising about these cases without reading the books that have been written. I recommend Trial by Ambush. Sir Joe Karam Missing pieces. (tamihere) Ian Wishart Who killed Scott Guy? Mike White. The Scene of the Crime (Mark Lundy) Steve Braunias. 10 bodies, six prosecutions, about 15 destroyed families, including children who the cops have lied to, in telling them their fathers brothers and sons are ruthless killers. 5 killers on the run with the police files closed. Of course none of that matters until it is your son... |

...but innocent of the crime if which he was accused, and free only because the jury had the good sense to see through the veil of fabrications put up by the Police and the prosecutors.
I will never understand why the Police and the Crown proceeded with a case they must have known that they could not possibly win once the exculpatory evidence of the time of the shooting was made public and could no longer be suppressed the way they had with the evidence of the time of the shooting in the AA Thomas case. As for Tamihere, he was a career criminal anyway, so I am more concerned that if he didn't do it, then that means the killer(s) of the Swedish couple is/are still at large. |

Wishart makes a compelling case for Huia George Foley. He was very strong, mentally unstable, and in the area. There is a conclusive sighting of the white Subaru with the Swedes' possessions in it 100 meters from Urban's body at the right time. Foley was challenged by his cousin later, and he said "they will never find her body".
Tamihere proved he opened the car with 8 wire, which is pointless if he was with them. Foley almost decapitated Hoglin sawing with a knife, and gave up. This was after he was dead, proven. David Tamihere is very bad but did not do this crime. These Swedes and their possessions were attended to by two bad men. This is a coincidence but nothing more. Once Foley abandoned the car with their possession still inside, Tamihere took over. He took tourists on a tiki tour in it for a couple of days in exchange for food and a motel room, value $12, then drove it to Auckland and abandoned it. Clearly his gene stock has high basic intelligence. People who think it is a doddle to become a cabinet minister are wrong, though I think Judith Collins has achieved it by blackmailing Key. David Tamihere forewent parole for 10 years because he would not confess to another man's crime. The team of John Hughes and David Morris, lead investigator and prosecutor, shamelessly and with much malice aforethought reprised their disgraceful behaviour with Arthur Thomas, by flatly lying to everybody who got anywhere near the case. It is a very good book, I will ask Wishart a few questions, particularly about any mooted alibi for Foley. By the way Crosby's clearing and the two there are out in any theory, including a possible Tamihere crime. That alone should explain why they are so confident to keep doing it. The promotion to district commander for Sue Schwalger after telling an 8 year old MacDonald child her father was a cold blooded killer when she knew this was false is just one more purulent abcess on its way to being lanced. The reason Collins got back in is simply down to the paucity of talent in National. Some of the BYM* Key gave his seal of approval to have been abject failures and he doesn't have any choice. He had to do something to Corrections and there is nobody else. Besides which, having Crusher there stops the emphasis on the appalling mess Corrections is in and instead focuses on her. *Bright Young Men. |

Collins is an international object of ridicule. Jurist Binnie perfectly understood that David Bain could neither expect his dad to ignore his 6 32 alarm or comply with being shot at point blank range at an angle that is exactly coincident with a man grasping a rifle with his right hand, locating the butt on the floor and leaning his left temple to the silencer, and pushing trigger with left thumb.

She's hard-nosed and doesn't care whose feet she stands on. Probably the only person capable of taking on Corrections at that stage, but the improvement had better carry through - National has screwed the department up royally. That is patently absurd. I hate the woman, her party, and everything she stands for, from the corruption around to Synlait to the fact that's she's a conniving, self-serving, devious Tory bitch. However, I can still see the facts, and they are - as Cully says - that she is a strong, effective cabinet minister with a good international reputation. The fact that a few Yanks and people posting at Injustice Anywhere don't like her is not "an international object of ridicule". If you believe your own words there, you are dead-set deluding yourself. Holy crap, I really hope you see the irony in that one day. If we use the word "fact" correctly, there is only one piece of evidence of Robin's death that meets the term. He died from a single .22 bullet to the head, including point and angle of entry. That's it. EVERYTHING else is opinion. |

Now that you realise that you should stop posting assumptions and opinions as facts.
As you say, facts are immutable, and therefore provable by evidence. There is no evidence that proves Robin shot himself. There is evidence that could suggest it to the gullible, but nothing like exculpatory evidence for David. Anyway, this is in the wrong thread, but since there's only us in it, let's hope nobody cries! |

Actually I am gonna write a book. It will cover the nine cases and name the main players. It will be based on court testimony and original scene analysis. I will mail it to every household in New Zealand including the caravan park in Avondale the Chinese bought and are throwing the residents on the street.
It will include Alec Dempster saying there was contact between the end of the silencer and Robin Bain's left temple, based on what he saw an hour after the murders. The crime scene is immediately solved. |
