Burkman, Wohl ordered to send corrective message to victims of US voter-intimidation robocall

Jack Burkman, 54, from Arlington, Virginia and Jacob Wohl, 22, from Los Angeles were ordered by a U.S. district court Wednesday to issue “curative” robocalls to individuals that were previously targeted by an alleged voter-intimidation scheme.

The two men have been accused of orchestrating robocalls to suppress votes in multiple U.S. cities -- specifically those with significant minority populations, like Detroit -- for the November election.

According to officials, the new robocall must be made by 5 p.m. Thursday and must contain the following message:

“At the direction of a United States district court, this call is intended to inform you that a federal court has found that the message you previously received regarding mail-in voting from Project 1599, a political organization founded by Jack Burkman and Jacob Wohl, contained false information that has had the effect of intimidating voters, and thus interfering with the upcoming presidential election, in violation of federal voting-rights laws.”

Surely the judge didn't order them to make the corrective calls in order to "get" them, but to try to mitigate some of the damage that they'd already done?

Intent doesn't really matter. Ordering a call that essentially requires an admission of error is a judge pretty much requiring Wohl to testify against himself for his upcoming criminal trial. It's risky.

In reality, the civil case should have been postponed pending the results of the criminal trial, or ordinary damages, without a stipulation for an "apology", should have been awarded.

Sure, but a judge ought to know better anyway and give a wide berth to possibly spoiling what otherwise might be a open and shut criminal case against these goons.

I suppose the calculation is between being able to punish them and undoing some of the harm they did. This judge apparently thought the latter was more important.

I think here that Popehat's view is mostly predicated on his political beliefs.

I suspect the prosecutors would have objected if they thought it would hurt the state's case. Since the state already brought charges, they could just not admit the evidence in the corrective calls and proceed without it.

"NEW YORK – New York Attorney General Letitia James today filed a request to intervene in a federal proceeding against two notorious conspiracy theorists over their efforts to suppress Black voters ahead of the 2020 election. An investigation conducted by the Office of the Attorney General (OAG) found that Jacob Wohl and Jack Burkman, while hiding behind their sham organization “Project 1599,” violated state and federal laws by orchestrating robocalls to threaten and harass Black communities through disinformation, including claims that mail-in voters would have their personal information disseminated to law enforcement, debt collectors, and the government."

There is a very real possibility that all these charges from various states (Michigan, Ohio and now New York) could be consolidated into a single federal case. Whatever happens, these assclowns are likely going spend a few years in the slammer.

Brit here. If I have learnt anything about the US in recent years, if one is white and/or wealthy one has has less chance of going to the big house. If those two clowns had been black, they'd be doing long stretches already and Fox news would be lambasting them.

Indeed. And being rich is not necessarily a requirement. Contrast the case of a black woman who accidentally commits electoral fraud and gets 5 years, while a white dude deliberately commits electoral fraud and gets probation. That kind of unjust inequity really steams my hams.

You're correct, I misread it: it's Burkman and Wohl plus the company Burkman & Associates LLC, not a company called Burkman, Wohl, and Burkman & Associates LLC. Beautiful.

Even if they're fined $5 million, can't they just declare bankruptcy and avoid having to pay ?

This might be different with the feds, but if you get sued in regular court they can garnish your wages, and put a lien against your credit. That could stop you from getting any loan from anyone (banks, institutions, etc.) for anything, and I'd assume these two idiots use their credit as much as possible. A judgement alone would stop you from getting a loan from anywhere that doesn't have the word "payday" in it.

Oh, I don't expect them to actually pay. But it's got to put a crimp in their operations.

Nope, these are Federal fines

11 USC § 110 precludes filing bankruptcy for the purpose of avoiding the paying of fines. This is called fraudulent preparation of a bankruptcy petition and can result in the tripling of your fine!

Also, the inability to pay the fine cannot be used as justification for the bankruptcy petition, i.e. you have to be able to show evidence that your bankruptcy petition should be granted before taking into account any fines you have to pay.
