Janet Protasiewicz May Be Impeached by GOP After Wisconsin Election Win
Janet Protasiewicz May Be Impeached by GOP After Wisconsin Election Win
So, you win an election to the state Supreme Court that gives liberals a 4-3 majority. Hey, not so fast there, lady! Don't you dare take that seat!

And though it seems outrageously ridiculous to think that none of the Republicans would say something like "wait a minute, that's a stupid and terrible thing to do," there's a chance that none will.

She is not yet on the bench. So they cannot impeach her from that position just now.

Two weeks, tops.
She is not due to take her place on the bench until August. I suspect cooler heads will prevail in GQP Wisconsin headquarters before then. They know that impeaching a judge who has barely taken her position is just going to look REALLY foolish for them. Way more foolish than usual. They are already losing the elections they have to fight. Why make that worse? |

If the GOP were smart they would let her take her spot on the supreme Court and just go after one of the currently serving liberal justices. Would still have the same effect (i.e. prevent liberals from gaining a majority) and assuming you can find SOMETHING on one of the serving Justice's it will seem less petty.

Most Wisconsin political commentators saying the impeach the judge movement will not get far. Political suicide, gerrymandering or no gerry mandering, for the GOP legislature to try to pull that off.

They be lookin' reel dum if they impeach this new judge and she is exonerated rapidly. Which is what would happen.
So they won't do anything, just rant. |

Not really there is no requirement that impeachment be a response to a criminal act. For example a Supreme Court of the US judge was impeached for being a drunk and a partisan hack.
It would be perfectly reasonable in a sane world to impeach Thomas for ethics violations even though they are not crimes. |

There is a vaguely similar comp from 2018 in WV. Two of five justices committed federal crimes and were rightly impeached and both resigned, but the legislature decided this was a chance to rid the court of Democratic justices and impeached everyone.
They at least didn't make it look completely blatant. They impeached (and immediately acquitted) the one GOP leaning justice. One of the Democrats resigned and the other sued to block impeachment. Which of course was a problem because there really wasn't a court to decide it. So they appointed a handful of circuit justices and they blocked the impeachment. The US supreme court refused to intervene. https://en.wikipedia.org/wiki/Impeac..._West_Virginia |

The Wisconsin governor is a Democrat who would certainly veto such a bill. To override a veto, both houses must have a two-thirds majority. The Assembly does not have a two-thirds GOP majority ( 61R-38D). The Senate has barely a 2/3rds supermajority with 22 of 33 seats so no Republican could vote "no".

Fair enough.
They could also just ignore it. Or in bad faith claim to be following it. It is a matter of how far GOP courts will go with the general idea of the sanctity of state legislative power. Current trends suggest pretty far. So they impeach, she sues to block, the Wisconsin courts with judges sitting by assignment blocks the impeachment. That's basically what happened in WV. Then the legislature either (a) still impeaches, tries, and convicts her and see where that goes and/or (b) appeals to the US Supreme Court on separation of powers grounds saying a state court has no right to review the impeachment decisions of the legislature because reasons. In WV the legislature kinda just gave up at this point because their main target (Davis) resigned rather than fight and there was a 4-1 conservative majority anyway. Wisconsin could be a little more hard nosed as keeping their gerrymandered map is the only way they maintain power. |

Is this still any more than a rumour?
The Gerrymandering must be strong if Dems can have a governor elected and a judge but gop have a super majority in the houses. |

Oh yeah, the Wisconsin Gerrymander is about as close to mathematically perfect as you can get in the real world. Check out the 2018 winning percentages in the Assembly.

Just did an image search for "Wisconsin gerrymander results". There are a couple of versions of it out there. The Wisconsin maps are gerrymandered to support the election of Republicans who will maintain the gerrymandered maps, with a (until recently) Republican State Supreme Court saying "Yeah, that's fine".
There's a reason the election of Protasiewicz is a big deal. |

The sad part is that so many people see a graph like that and don't understand it. They'll see those >90% Dem districts as proof that the gerrymandering favors the dems. As in, they don't understand the "packing" part of "packing and cracking".
I've even seen that here in this forum, and I like to think that we forumites are more knowledgeable than average. |

Gerrymandering is simply manipulation of real estate, not total vote count.
