Police Officer Using Slight-of-Hand to plant drugs

Check out the Slight of Hand the officer uses to plant some Meth on this innocent woman. Trying to go about her business, and this guy thinks he needs to plant a felony drug charge on her.

In my opinion he should go to jail for a long time.

Can't watch the videos right now. How clear was it?

The article states that he was fired from his position. I'd agree there should be more of a punishment than that. His past cases should also be reviewed.

Could you imaging being pulled over for going 5 miles over the speed limit, and then having the officer find crystal meth that you know you didn't have?

Can't see that from here. What was the original offense?

He palms a small plastic packet and then pretends to find it in the car. The packet is clearly visible in his hand before he puts on his gloves to conduct the search.

It was clearly palmed in the officers left hand, there is a slo motion video breaking it down. I didn't see it in the first video run through, but once I knew where it was, I went back and could clearly see it in the first video. Look in the palm of his left hand while he is fidgeting around with his gloves.

He stopped her because 'her brakelights would work sometimes, but not other times'

It's very clear, if it wasn't such a serious matter it would be comical watching how he tries to avoid his body camera picking up him planting the evidence.

Not to mention how fake it was to put his gloves on the seat then put them on.

Now, now maybe it was an honest mistake which under the legal concept of mens rea apparently means everything that happened afterwards is okay.

IN HIS MIND maybe she had meth.

Yes; this. It doesn't matter if everyone else agrees he planted the meth, if in his mind and his perception she had it all along, his opinion wins.

He should be busted for possession and given the same kind of harsh sentence that too many minority offenders get.

Besides being vile, like the findings about not giving out complaint forms just revealed (there's a thread here somewhere)...

... His past cases should also be reviewed.
...

Trying to sweep him under the rug (by immediate firing) isn't gonna work for this precinct.
A herd of lawyers is about to drop on them to re-open/re-examine every drug case this mook has ever had.

They can kiss their budget goodbye... it just got blowed up.

They are investigating 263 cases he was involved in. Will he be charged with 263 "Possession with intent to distribute"?

Doubt it. I live a county away from Jackson and there are a lot of meth busts in this part of the panhandle due to the smalltown atmosphere. Once you’ve been popped for drugs, you might as well drive with a DeadHead flag on your antenna because they never forget your face or your history. Many arrests in my area come from face recognition just from an officer driving by. The subsequent search is a matter of routine usually with the dog conducting an “open air search” of the vehicle.

I watched the posted video of the arrest. Clearly the deputy concealed something in his left hand. Last year we had a deputy accused by a citizen’s group that watches for such behavior. The officer was accused not only of having internet sex while on duty but also for underreporting the amounts of confiscated drugs seized in a traffic stop. Possibly this deputy in the video does the same. I find it humorous that his own body cam ratted him out but I wouldn’t hold my breath waiting to see some serious charges against him. Maybe he’ll end up in my county.

That said, somehow I get the feeling that this wasn’t that lady’s first rodeo either but I hope they cut her loose on this one.

Just riffing off of Mycroft's comment:

This is why you never give your consent for a search.

The PoPo might come back with a "then I'll get a K9 unit to search the car"

But you can decline to give consent for the dog to search your car, as well.

There's also a law which states that the fact that you refused to give consent to search your car does not then give them "probable cause" to search your car.

I saw on Youtube, so it must be true.

These are the kinds of talks that are hard to have with your kids. Trust the cops. The cops are there to help. Our friends are cops. But don't ever let a cop search your home or vehicle with out a warrant and don't ever talk to a cop without an attorney. It sucks.

Anecdote that I share with my kids:

I was taking a friend home one day and let him put his stuff in my car until we were ready to leave. As I was driving away form dropping him off he chased me down. He reached in the window and pulled a bag of what I must assume was oregano out from under my seat.

A few minutes later I was pulled over on the way back to my house. I nearly **** my pants. A DUI or minor in possession of alcohol at that time was not such a big deal. A big ziploc of herb would have ruined my life.

Our approach when the kids became teenagers began with 'Remember how we used to tell you about Santa Claus?...'

So what would be the motive for this idiot?

Gets off on screwing people over or do the cops have some kind of drug catch quota?

Until there are actual consequences and they are rooted out permanantly the scum in the police will continue to use these tactics and increase in number. They should be treated at least as bad as dealers when caught, and if their partners/colleagues are complicit then they should be charged with concealing a crime and obstruction of justice. The us vs them mentality needs to die. There is no point in having police if criminals are the police.

In my American experience, some cops just want to get bad guys. They don't care if they are really bad guys or not. He might have thought the driver looked shady and needed a good excuse to rip that car apart to get to the good stuff.

The laws probably vary in each jurisdiction but I believe the open air is used when consent to search is denied. The dog is led around the vehicle without touching it and if the dog “alerts” then the officer has probable cause.

I always wonder how they can be sure that the scent the dog alerted on actually came from the vehicle in question as opposed to a nearby meth lab or even the officer’s clothing or equipment if he had done an arrest earlier in the shift.

TBF if the dogs are as well trained as the ones I have seen you can pretty mu ch rule that out.

They are pretty amazingly pin pointy

He did it because he is racist. This is an example of everyday racism against white people.

Yep, she was obviously a druggie who was going to get away on the technicality that she already used up all her drugs. That's not fair.
