Attorneys for Hovinds seeks acquittal on bank structuring

Kent and Jo Hovind were back in federal court this week seeking acquittal on charges of bank structuring.

The couple's attorneys argued there was no intent to defraud the government by making large deposits just under the $10,000 threshold that triggers bank-reporting requirements.

He remains in the Escambia County Jail awaiting transfer.

A date for Jo Hovind's sentencing has been delayed pending a ruling by U.S. District Judge Casey Rodgers on the request for acquittal on the bank structuring conviction.

No date has been set for her ruling.

Does Hovind talk to his attorney? If he does, how much English does he understand? If he understands English quite well and talks openly to his attorney, just further proof of delusion...

Just one aspect of his conviction.

Hovind, March 7, 2007 told his sheep:

I am still in the Escambia County Jail—just over four months now. Our attorneys are still filing motions with District Judge Casey Rodgers to drop the charges, acquit the case, and release me from jail. When all of these are ruled on, if she does not overturn the case, it will go to the 11th Circuit Court of Appeals.

Thus, if the judge did side with Hovind on hearing a few days ago, which means the judge misreads the law and ignores precedent, he'd still be going to prison for the obstruction and willfull failure to pay taxes.

However, Hovind delusional as ever, thinks he'll be able to go free and continue spreading lies about science at a fundamentalist church near you.

My favorite part in Pigliucci vs Hovind is when Hovind says "I don't know why you're calling him dr and me mister." It sums up Hovind's understanding of academics nicely.

Oh the irony when he says, "If you want to believe a dog came from a rock 4.6 billion years ago you're welcome to believe that" and concludes at 13:15 "I you're not wlecome to use my tax dollars to teach it to all the rest of the kids." But Kenny boy wasn't paying his taxes.

6:30 am Moved by car to a different part of the jail to another freezing cold “tank” to wait
9:10 am Saw Federal Marshals arrive to transport me to a Federal Prison Camp in Pensacola. This minimum security federal facility was designed for 300 but houses 700 men. All these men work to help maintain military bases in the area.
11:00 am Finish intake details including a physical. Lost 25 pounds in the County Jail
11:15 am Served first good hot food in four and a half months!
12:00-10:00pm Free to roam, well, sort of free. For the first time in four and a half months, I felt a blade of grass; wore tie shoes, a belt, and a real shirt and pants (no jump suit!); got a locker with a lock; and slept on a bed with a real pillow. Feeling the sunshine for only the fourth time in four and a half months made me want to walk around the camp all day!

2:00-5:00 Scrubbed down a grill as health inspection is coming up My boss loved my work! He said it is the best the grill has looked in years.

There is a video library here, and our creation video tapes have been here for many years. They were very well worn. They were also removed the afternoon after I arrived. There seem to be many men who had watched them and know me and who have followed my case during the past months. Several concerned brothers showed me around and supplied me with things I needed, including a watch and tennis shoes. God is sooooo good!

The Motion for Acquittal of Counts 13 - 57 is still on Judge Rodger’s desk. If she grants that, she will have to re-sentence me. Then the 11th Circuit will get our Motion for Release Pending Appeal.

Thanks for your faithful prayers. I will never forget the great time with God in the county jail. Truly, His grace is sufficient! Many men’s lives were changed for this life and for eternity. They still love to get mail and tracts. My new, hopefully short-term, address is:

After listening to the "Jared Hoag #54" mp3 - near the end, Hovinds mentions that he believes evolution supporters will kill anyone who searches for evidence to the contrary? Do I understand that right? That's beyond insane.

Then how do you explain how anyone who looked for such evidence dies before they find it? Coincidence I think not!

Next May, the national identification card containing a microchip will be mandatory in the United States. One man in the county jail with me was from Latvia. He told me his dad, as well as millions of others in the European Union, have a microchip implanted in his right wrist to speed border crossings. He thought it was a great idea and couldn’t wait for the idea to catch on in America! Even after I showed him Revelation 13:11-18, he was unchanged. It was as if he was blinded to the truth. By the way, the KJV says the mark will be “in the hand” which includes the wrist (Genesis 24:22), while nearly all other Bible versions say “on the hand.” This is yet another reason for sticking with the King James Version.

I doubt he'll be present at the hearing as his complaint is rather silly and he's in prison now. He won't be getting anymore prison time. His wife will be sentenced soon though.

Wonder what his wife will get. Probably not as long, I think. Hope she divorces him when she gets out of prison.

Clearly Hovind believes he'll be out in May. So I guess the ten year prison sentence wasn't serious? I wonder what was told to these places to get the dates confirmed.

Also worth noting, Trinity Christian Academy is a elementary school.

Wasn't it G.K. Chesterton who wrote something to the effect that, if you don't believe in God, you'll believe in anything? An amusing aphorism, but obviously wrong.

Where's the investigative journalism? These places are obviously contactable. Now that we have blogs, you can just pretend to be a reporter. "Hello? Yes, this is Questioninggeller from the JREF forums, and I'm calling to see.... yes... that is my REAL name... now... I'm calling to see if you're still going to have Kent Hovind speaking at your institution now that he has been imprisoned?" I mean, I'd do it, but I have no social skills.

I contacted evangelical groups and gave them information regarding other cases. The response has never been positive. It has always been "repent now," you're going to "burn in hell," and so on for questioning claims.

If these groups follow and listen to Hovind despite him getting sentenced to 10 years in jail there is no helping them. They don't care about truth since it doesn't mesh with their world views.

Update: Those dates now list Eric Hovind as the presenter.
 
Personally, I'm still of the opinion that Kent will be on Dubbya's parting pardon list as he leaves the Oval Office in 2009 as a last kiss goodnight to the fundies to keep help them in the GOP camp.

Hovind's far below the White House's radar. Keep in mind Hovind is also a 9/11 conspiracy theorist, Loch Ness monster believer, and has enemies within the creationist circle.
 
Good point. If it were Michael "Astrology Is A Science" Behe, or Jonathan "Moonie" Wells or another Discovery Institute big shot, would a pardon be more probable?

Still, the Jesus freaks have two years to twist this guy into a folk hero. All I'm saying is that I won't be at all surprised if it happens.

Judge denies appeal from Hovind, wife on tax charges

April 20, 2007

An appeal by Pensacola creationist Kent Hovind and his wife, Jo Hovind, seeking acquittal on tax-fraud charges was denied.

U.S. District Judge Casey Rodgers upheld the Hovinds' November 2006 conviction on 44 counts of bank-structuring -- the withdrawal of bank funds under the $10,000 threshold that triggers bank reports to the Internal Revenue Service.

During the trial, prosecutors presented evidence that showed the couple routinely withdrew $9,500 and $9,600, from their bank.

Jo Hovind was convicted of 44 counts of evading bank-reporting requirements. Her sentencing was delayed pending the appeal and should soon be set.
